Hedgefonds investieren möchten, um mehr Unabhängigkeit von aktuellen Marktkonstellationen zu erreichen, sowie die Effizienz ihrer Anlageportfolios zu erhöhen. Das zunehmende Interesse an sogenannten Hedgefonds-Zertifikaten in Deutschland ist ein Beleg hierfür. Von diesen Produkten können jedoch auch erhebliche Risiken ausgehen, was in der Vergangenheit durch den Niedergang einiger der bekanntesten Vertreter dieser Gruppe eindrucksvoll demonstriert wurde. Eine ausreichende und sinnvolle Regulierung ist daher von Nöten.

Der zunehmenden Bedeutung von Hedgefonds und dem damit einhergehenden Regulierungsbedarf wird in Deutschland aktuell nicht Rechnung getragen. Entwicklungen der letzten Zeit deuten jedoch auf einen Wandel in der Regulierungspolitik hin. Zu hinterfragen ist, inwieweit diese Bemühungen der Problematik gerecht werden, vor allem im Hinblick auf das sehr mobile Verhalten der Branche sowohl in geografischer Hinsicht, als auch im Umgehen von bestehenden Regularien.

Im 2. Kapitel wird zunächst eine Einordnung und Definition von Hedgefonds vorgenommen, die historische Entwicklung aufgezeigt und typische Investment-Strategien vorgestellt. Kapitel 3 zeigt, inwieweit Hedgefonds zur Optimierung von Portfolios geeignet sind und erörtert sowohl die Bedeutung von Hedgefonds für unsere moderne Ökonomie als auch die potenzielle Gefahr, die von ihnen ausgehen kann. Das 4. Kapitel gibt schließlich einen Überblick über die Regulierung in Deutschland und in den USA und stellt den Entwurf des Investmentmodernisierungsgesetzes vor. Abschließend wird sowohl der Sinn als auch die Grenzen einer Regulierung von Hedgefonds diskutiert.
