Die Strafe als Sanktion existiert eigentlich schon immer, seitdem es das menschliche Zusammenleben gibt(1). Das ursprüngliche StGB für das Deutsche Reich entstand im Jahre 1871, wobei es sehr an das Preußische StGB aus dem Jahre 1851 angelehnt war(2). Hier fand der Vergeltungsgedanke deutlich seinen Niederschlag, das wiederum mehr die vorangehende Tat abschloss, als an eine zukünftige Prävention zu denken(3).

Über die Auffassung von Strafe werden verschiedene Thesen vertreten. Die eine Ansicht beruht auf der absoluten Straftheorie, die andere auf der relativen Straftheorie. Die absolute Straftheorie sieht mehr den Vergeltungsgedanken im Vordergrund, also die Schuld des Täters auszugleichen(4). Die relative Straftheorie versucht wiederum mehr vor zukünftigen Straftaten vorzubeugen. Dies soll vor allem dadurch erreicht werden, potentielle Täter, die in Betracht kommen könnten, durch die Strafe abzuschrecken(5). Auch muss es Ziel sein, eine straffällig gewordene Person wieder in die Gesellschaft einzugliedern, ihn gegen mögliche Versuchungen weiterer Straf-taten resistent zu machen (Resozialisierung)(6) . Nicht zu vergessen ist natürlich, die Allgemeinheit vor Tätern durch die Strafe zu schützen(7).
